LP 09: Governance and Legislation (48 Credits)


Learning Programme Description

This course is designed for l earners who are, or who seek to be employed in a municipal environment at middle to senior management level. It provides the learner with the competencies to communicate their knowledge of municipal financial management and operating processes to municipality stakeholders and role-players, and through facilitation skills, to secure effective and efficient implementation. This course also caters for political executives, municipal managers, strategic executive managers and other role-players who seek to contribute to the development of relevant legislation and policy affecting financial management and implementation of municipal financial management programmes. Practitioners in local government who are involved in decision making processes that impact on how a municipality interacts with other organs of state and spheres of government and advice on the legislative mandate of municipalities from a provincial and national government perspective will also benefit from this qualification. This course covers the following topics: conducting stakeholder consultation on municipal finance programmes; a pplying the principles of ethics in a municipal environment; a pplying the Inter-governmental Fiscal Relations Act to municipal financial management; i nterpreting legislation and policy affecting municipal financial management; and d iscussion of the selected legislative regulatory framework governing the public sector management and administration environment.


Learner Outcomes

After completion of this course learners will be able to:–

  • Identify and describe relevant stakeholder and role players in a municipal environment
  • Select and apply a range of appropriate negotiation and communication techniques and methods
  • Assess application of communication techniques and methods and draw up a plan of action
  • Evaluate the communication process and make recommendations for improved interaction
  • Demonstrate knowledge and insight into existing legislation, regulations and codes
  • Apply the principles of ethics and professionalism to a municipal code of conduct assessment criteria
  • Develop an implementation plan to achieve compliance with an established code of ethics
  • Interpret the legislative requirements for cooperative government at local government Level
  • Comply with the constitutional provisions regulating provincial supervision of local government
  • Interpret the legislative requirements of the Division of Revenue process and intergovernmental transfers
  • Identify and apply the regulations governing Division of Revenue
  • Identify and implement the conditions of IGFR transfers to Local Government
  • Apply legislation governing municipal borrowing powers
  • Interpret financial information and provide financial advice to achieve the municipal strategy
  • Interpret the South African constitution in relation to public sector financial management
  • Apply legislation in the public sector financial management and administration context
  • Apply legislative regulations and legal principles to contracts
  • Manage the implementation of the Municipal Finance Management Act

Entry Requirements

Matric or equivalent or higher with competence in communication, economics and mathematical literacy. Experience of working in the local government environment will be beneficial .
